New California Law Provides Revival Window for Sexual Assault Survivors to Seek Justice


If you are a survivor of sexual assault in California, a new law taking effect in 2026 will provide a renewed opportunity to file civil claims and hold perpetrators and enabling institutions accountable, even if the statute of limitations had previously expired on your case.


Assembly Bill 250 (AB 250), signed into law in 2022, creates a two-year "revival window" from January 1, 2026 through December 31, 2027. During this period, adult survivors of sexual assault whose claims were previously time-barred under the statute of limitations will be able to file civil lawsuits in California against perpetrators and private entities that enabled the abuse or assault.


This revival window applies to claims against assailants as well as private organizations that failed to protect victims from known abusers. It also allows for related claims stemming from the assault, such as wrongful termination or sexual harassment.


However, the window is only open for two years, so it is critical that survivors act promptly once the law takes effect to have their voices heard and pursue the justice and accountability they deserve. You do not have to stay silent any longer.
